These terms apply to every vehicle purchase from Ultimate Motorsport Inc ("Ultimate Motorsport," "we," "us"), whether the purchase begins on this website, on eBay Motors, by phone, or in person. By placing a deposit, submitting an offer or bid, or signing a purchase agreement, you agree to these terms.

1. All vehicles are sold AS-IS

Every vehicle is sold AS-IS, WHERE-IS, with no warranty, express or implied, unless a written service contract is purchased separately. The FTC Buyers Guide displayed on the vehicle and signed at delivery is part of the sale contract and controls over any other description, listing, or conversation. Pre-owned vehicles may have wear, prior repairs, or cosmetic imperfections consistent with their age and mileage. Optional extended service contracts are available on most vehicles.

2. Vehicle descriptions and inspection

Listings are prepared from the manufacturer's data, a CARFAX vehicle history report, and our own inspection. We disclose what we know about each vehicle, but no description is a guarantee of condition. You are responsible for inspecting the vehicle, or arranging a third-party inspection at your expense, before purchase. Vehicle history reports are provided by third parties, and we do not guarantee their completeness or accuracy.

3. Pricing, taxes, and fees

• The advertised price is the vehicle price. We do not add dealer add-ons, packed fees, documentation packages, or reconditioning charges.
• Texas buyers pay 6.25% Texas motor vehicle sales tax, title and registration fees as set by the State of Texas and Harris County, and Texas Vehicle Inventory Tax (VIT) at the rate set annually by Harris County (currently .002834 of the purchase price, about 0.28%).
• Out-of-state buyers are responsible for their own state's sales tax, title, and registration. We do not collect taxes for other states.
• Prices and availability are subject to change without notice. Every vehicle is subject to prior sale until a deposit is received. If a listing contains a pricing or typographical error, we may correct it or cancel the sale and refund any deposit; we are not obligated to sell at an erroneous price.

4. Deposits and payment

• A $500 deposit is due within 24 hours of a sales commitment. Deposits are non-refundable and are applied to the purchase price.
• The balance is due within 7 days of the deposit. If the balance is not received, or no contact is made within that time, we may re-list the vehicle, sell it to the next buyer, or sell it otherwise, and the deposit is forfeited.
• We accept cash, bank wire, cashier's check, and financing through our lender network. Vehicles are released only after payment has cleared.
• Financing is available with approved credit (WAC) only. A financing application is not a purchase and does not hold a vehicle.

5. Shipping and delivery

We ship to all 50 states through licensed carriers. Shipping quotes are estimates until a carrier is booked, and delivery dates are estimates, not guarantees. Risk of loss passes to you when the vehicle is released to the carrier. Any transport damage must be noted on the carrier's bill of lading at the time of delivery for a claim to be honored; claims for transport damage are made against the carrier.

6. Titles and registration

Titles are processed after payment has cleared. Texas title and registration are handled through our title service. Out-of-state buyers receive the title documents needed to register the vehicle in their own state.

7. eBay Motors and online-offer purchases

If you buy through eBay Motors or by submitting an online offer: by placing a bid, making an offer, or clicking Buy It Now, you agree to these terms. A winning bid or accepted offer is a sales commitment and starts the 24-hour deposit period in Section 4. Buyers who do not complete the purchase may be reported to eBay as non-paying bidders.

8. Disputes

Any dispute arising from a purchase, this website, or these terms will be resolved by binding arbitration in Harris County, Texas, under Texas law, as set out in the arbitration agreement signed at purchase. The signed purchase documents (Buyers Guide, AS-IS Rider, Warranty Waiver, and purchase agreement) are the entire agreement between you and Ultimate Motorsport Inc and supersede any listing, advertisement, email, or conversation.
